These Terms and Conditions (“Terms”) govern your access to and use of the Now Fluent website (the “Site”) and any related services, content, and features made available through the Site (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
“Now Fluent”, “we”, “us”, and “our” refer to the team operating the Now Fluent brand and Services. If you need to contact us, use the contact options listed on the Site’s Contact page.
2. Eligibility
You must be legally able to form a contract where you live to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. What the Services include
The Services may include:
Information about the Now Fluent story-driven Spanish-learning game (“Now Fluent Game”), including trailers, screenshots, and descriptions.
Pages describing how the learning method works and who contributes to the content (e.g., teachers, translators, native speakers).
Marketing and educational content about learning Spanish through speaking missions.
Contact forms or other ways to reach us.
The Site is informational. The Now Fluent Game itself is typically downloaded and used through third-party platforms (e.g., the Apple App Store and Google Play). Your use of those platforms and the Now Fluent Game may be governed by additional terms from those platforms and/or separate product terms.
4. Accounts
Some parts of the Services may require you to provide information or create an account (for example, to submit a form). You agree to provide accurate information and keep it up to date.
5. Purchases
If you purchase the Now Fluent Game through a third-party platform (such as the App Store or Google Play):
The payment, billing, refunds, cancellations, and chargebacks are handled by that platform and governed by its terms.
We do not control platform fees, taxes, or exchange rates applied by the platform.
If you have a billing issue, please contact the platform first.
If the Site offers any direct purchases in the future, additional purchase terms may apply and will be presented at checkout.
6. Educational nature; no guarantees
Now Fluent is designed to help you practice Spanish through story-driven, speaking-based missions and related learning experiences.
Language learning outcomes vary widely based on consistency, prior experience, and other factors. We do not guarantee that you will achieve any specific level, fluency, or outcome by using the Services or the Now Fluent Game.
7. Intellectual property
All content on the Site and within the Services—including text, graphics, logos, videos, screenshots, game story elements, character names, artwork, and other materials—is owned by or licensed to Now Fluent and is protected by intellectual property laws.
You may view and use the Services for your personal, non-commercial purposes. You may not copy, reproduce, distribute, publicly display, sell, license, or create derivative works from the Services or content without our prior written permission, except where permitted by law.
8. Acceptable use
You agree not to:
Use the Services in a way that violates any applicable law or regulation.
Attempt to gain unauthorized access to the Services, systems, or networks.
Interfere with or disrupt the Services (including by introducing malware or abusive traffic).
Scrape, crawl, or harvest data from the Site except as permitted by law and by any robots.txt or similar directives.
Misrepresent your identity or affiliation when interacting with us.

You represent that you have the right to provide the Submission.

Please do not send confidential or sensitive information via the Site unless explicitly requested.

12. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available”. We disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content will be accurate, complete, or up to date.
13. Limitation of liability
To the fullest extent permitted by law:
Now Fluent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Services.
Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us (if any) for the Services in the 12 months before the claim arose.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Now Fluent and its team members from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your Submissions, or your violation of these Terms.
15. Changes to the Services and Terms
We may modify, suspend, or discontinue any part of the Services at any time.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above. Your continued use of the Services after changes become effective means you accept the updated Terms.
16. Termination
We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms or if we need to protect the Services, users, or our rights.
17. Governing law
These Terms are governed by the laws of the jurisdiction where the Now Fluent operator is established, without regard to conflict of law principles, unless applicable law requires otherwise.
